UAE Free Zone Company Formation: Choose the Activity Before the Package

Write down what the company will actually do

An attractive formation package is not useful if it is built around the wrong activity. Start with a specific description of your proposed products or services, customers, delivery model, and staffing plans.

The UAE Ministry of Economy and Tourism's free-zone formation guidance begins with identifying the business activity and legal form, followed by the trade name, offices or facilities, approvals, and registration (UAE Ministry of Economy and Tourism). Use that sequence to organise your questions rather than starting with a promotional package price.

Avoid descriptions so broad that every provider can say yes. “Consulting” may be a useful shorthand, but the adviser assessing your proposal needs to understand the work you will actually perform.

    Compare like with like

The Ministry notes that free-zone entities are subject to their respective authorities' rules and that not every legal form is available in every free zone (UAE Ministry of Economy and Tourism). Ask each candidate provider to respond to the same written brief.

    Your comparison should distinguish:

    • Activity fit: Which proposed activities are covered, and which need further review?
    • Legal form: Why is this form recommended for your ownership and operations?
    • Facilities: What office or facility arrangement is included and what does it permit?
    • People: What assumptions does the proposal make about staffing or immigration needs?
    • Continuing support: Who manages renewals, changes, notices, and recordkeeping?

Do not assume two packages with similar names provide the same scope. Request a written list of exclusions and likely decision points.

    Build around approvals, not promises

The Ministry's guidance includes obtaining the relevant approvals and supplying supporting documentation as part of formation (UAE Ministry of Economy and Tourism). Ask the authority or qualified adviser to confirm the requirements for your facts.

Separate the activities that can happen in parallel from those that depend on an earlier approval. An internal project plan should show those dependencies and who will supply the information. That is more useful than repeating a best-case completion time.

Keep tax, licensing, immigration, and financial-account questions visible as distinct workstreams. A provider may help coordinate them, but coordination should not be mistaken for a blanket approval.

Test the package against the first year

Imagine a realistic change: another shareholder, a new employee, or an additional service. Ask what that change would require and who would manage it. The answer helps you assess whether the arrangement fits the business you intend to build, not only the business on the application form.

General educational information, not legal or tax advice. Confirm current requirements with an appropriately qualified adviser.
